NJDEP Oil Tank Removal Regulations in New Jersey

Overview: Who Regulates Oil Tank Removal in NJ?
Oil tank removal in New Jersey is regulated by two agencies: the New Jersey Department of Environmental Protection (NJDEP) at the state level, and your local municipal building department at the local level. Both must be satisfied before a removal is considered complete.
The NJDEP's primary regulatory framework for underground storage tanks (USTs) is found in N.J.A.C. 7:26E β the Technical Requirements for Site Remediation. This regulation governs how soil sampling must be conducted, how contamination must be reported, and what constitutes a clean closure.
Key NJDEP Requirements for Oil Tank Removal
1. NJDEP-Certified Contractor Requirement
All underground oil tank removals in New Jersey must be performed by a contractor licensed by the NJDEP. Homeowners cannot legally remove their own underground tanks. The contractor must hold a valid NJDEP certification and carry appropriate liability insurance.
2. Municipal Construction Permit
Before any excavation can begin, a construction permit must be obtained from the local municipal building department. The permit application typically requires the property address, tank size and location, contractor license number, and a site diagram. Most NJ municipalities process residential tank removal permits within 3β7 business days.
3. NJ One Call (811) Utility Mark-Out
New Jersey law requires that NJ One Call (811) be contacted at least 3 business days before any excavation. NJ One Call coordinates with all utility companies to mark the locations of underground utilities (gas, electric, water, cable, fiber) on the property. This is a legal requirement, not optional.
4. Soil Sampling Requirements (N.J.A.C. 7:26E)
Under N.J.A.C. 7:26E, soil samples must be collected at a minimum of four locations around the tank pit immediately after tank extraction. The samples are analyzed for petroleum hydrocarbons (TPH), benzene, toluene, ethylbenzene, and xylenes (BTEX). If the tank is larger than 550 gallons, additional samples may be required.
Samples must be sent to a NJDEP-certified laboratory. Results must be reviewed by a Licensed Site Remediation Professional (LSRP) if contamination is detected above NJDEP soil remediation standards.
5. The LSRP Program
New Jersey's Licensed Site Remediation Professional (LSRP) program, established by the Site Remediation Reform Act of 2009, requires that any contaminated site be overseen by a licensed LSRP rather than going through the traditional NJDEP case manager process. This was designed to speed up remediation timelines. If contamination is found at your property, an LSRP must be retained to oversee the remediation and issue a Response Action Outcome (RAO) β the document that formally closes the case.
6. Reporting Requirements
If contamination is discovered during a tank removal, the LSRP or contractor must report it to the NJDEP within specific timeframes. Discharge of petroleum products to the environment is a reportable event under the New Jersey Spill Compensation and Control Act (N.J.S.A. 58:10-23.11). Failure to report is a violation that can result in significant fines.
What Constitutes a "Clean Closure"?
A clean closure occurs when soil sampling results show no contamination above NJDEP soil remediation standards. In this case, the contractor files a closure report with the NJDEP, and the homeowner receives a Certificate of Removal and NJDEP case number. No further action is required.
A clean closure is what the vast majority of homeowners receive β approximately 70β80% of residential tank removals in NJ result in clean closures with no remediation required.
